Terms and Conditions

Agreement to Terms:
It is assumed purchaser agrees and accepts these Terms and Conditions of Sales by entering into a business arrangement to purchase product from ARIAS Industries, Inc.

Orders:
All orders must have a P.O. number or purchasing agent's name to be valid. No order will be considered valid until that order ships from ARIAS’ facility and an invoice is issued. The minimum order on custom pistons is four. Shelf-stock pistons and hardware may be purchased singularly.

Sales Policy:
All orders will be priced according to ARIAS’ current “client” (BCC) price schedule. A discount will be extended to all qualifying jobbers, dealers or warehouse distributors. A copy of business license or other proof (i.e. phone directory listing) must be received before discounts are extended. ARIAS reserves the right to change prices without notification, although every attempt will be made to notify in advance.

Terms:
ARIAS accepts cashiers check, company check, credit card (Visa, Master Card, Amex and Discover) and/or wire transfer. Initial custom piston orders require a 50% deposit prior to order processing, with balance paid by C.O.D. Subsequent orders will ship C.O.D. for the full amount and company checks (once approved) will be accepted. Qualifying accounts are eligible for credit terms; consult your ARIAS sales associate. International orders require 100% prepayment.

Please note: If an account must be placed into collection, the purchaser will be responsible for all related professional recovery fees.

Sales Tax:
Non-refundable sales tax will be charged on all invoices to California purchasers unless a resale card is on file with ARIAS at time of invoicing.

Shipping Freight:
All orders will be shipped by the fastest, most economical way unless otherwise specified. All shipments are F.O.B. Gardena, California. Drop-ship service is available at $10.00 per shipment in addition to any drop-ship fees charged by ARIAS suppliers.

Warranty Disclaimer:
Due to the nature of high performance applications, ARIAS Industries, Inc. products are sold without any express or implied warranty of merchantability or fitness for a particular purpose. ARIAS shall not, under any circumstances, be liable for any special, consequential or incidental damages, including, but not limited to, loss of profits or revenue, loss of other property or equipment, cost of purchased or replacement goods, or claims of customers of the purchaser, which may arise and/or result from the sale, installation or use of these parts. Installation of these parts could adversely affect the vehicle manufacturer's warranty coverage. Subject to applicable state law, some items may not be legal for use in California on pollutioncontrolled vehicles. The purchaser and/or customer is responsible for checking state and federal emission regulations.

Claims and Returns:
All ARIAS Industries, Inc. products are warranted to be free from defects in material and workmanship. The end user is responsible for inspection of goods before use. Modified, altered or used parts will not be accepted for return or exchange. Custom piston sales are final. Credit, repair, or replacement of goods is predicated upon factory inspection of the product in question. In lieu of cash reimbursement, all corrections will be handled by credits to customer’s account or exchanges. Credits or exchanges will be subject to a 15% handling charge, pending the circumstances under which the materials are returned. No returned merchandise will be accepted without prior authorization. Freight collect returns will be refused. Any request for refund or exchange must be made within 90 days of invoice date. All returns must be accompanied with a copy of the ARIAS invoice and a return merchandise authorization (RMA) rom an ARIAS sales associate.

Notice: ARIAS reserves the right to make changes in design, specifications, materials and/or pricing of its products without incurring liability or obligation with respect to similar products previously manufactured.
